SEAX is the name that Essex County Council has given to the computer program designed and written for the Essex Record Office. Unlike some other computer program names, SEAX is not an acronym: the letters do not represent words. A seax is a curved Saxon sword, and a row of three seaxes appears in the symbol of the county of Essex. Below is an extract from SEAX of part of the records containing a reference to Henham (some may concern Henham in Suffolk). The remaining records are at SEAX part2


attornment (from Fr. tourner, “to turn”),
is the acknowledgment of a new lord by the tenant on the alienation of land. Under the feudal system, the relations of landlord and tenant were to a certain extent reciprocal. So it was considered unreasonable to the tenant to subject him to a new lord without his own approval, and it thus came about that alienation could not take place without the consent of the tenant. Attornment was also extended to all cases of lessees for life or for years. The necessity for attornment was abolished by an act of 1705.

burgage
- A medieval land term used in England and Scotland, well established by the 13th century. A burgage was a town (borough) rental property (to use modern terms), owned by a king or lord. The holder of which was known as a burgess. The property (”burgage tenement”) usually, and distinctly, consisted of a house on a long and narrow plot of land, with the narrow end facing the street. Rental payment (”tenure”) was usually in the form of money, but each “burgage tenure” arrangement was unique, and could include services. As populations grew, “burgage plots” could be split into smaller additional units. Burgage tenures were usually monetary based, in contrast to rural tenures which were usually services based.

carucate
- the carucate was a unit of assessment for tax found in most of the Danelaw counties of England. The word derives from caruca, Latin for a plough. It is analogous to the hide, the measurement of land for tax assessment used outside the Danelaw counties. In the Domesday Book the carucate was nominally 120 acres (490,000 m²), based on the area a plough team of eight oxen could till in a year. A carucate was sub-divided into bovates and these were based on the area a single oxen could till in a year, they were therefore one eighth of a carucate. The tax levied on each “carucate” of land came to be known as “carucage”.

demesne - the property held by the lord of the manor himself

demise - term used to when a real property is leased or transferred for years or life, but not beyond

escheator
-escheat is a common law doctrine that operates to ensure that property is not left in limbo and ownerless. The shire officer or escheator, in England, was responsible for the administration of land grants and feudal rights relating to land and fiefdom.

essoin - an excuse for not appearing in court at the return of process; the allegation of an excuse to the court

fealty - the fidelity owed by a vassal to his feudal lord

feoffment
- similar to a deed of gift recording the sale of real property (land or buildings). It developed in the Middle Ages. Sale of real property (land or buildings) from one party to another, for a monetary consideration. The amount of money involved is not usually specified until around the sixteenth century. Feoffments record in the past tense what has been done to transfer the property.

They make reference to the practice of ‘livery of seizin’ which was a ritual in which a physical piece of land (a clod of earth or a twig) was given from the seller to the purchaser, to represent the passing of the freehold. A memorandum of livery of seizin was written onto the back of the document (endorsed) from the fifteenth century onwards.

frankpledge
- a pledge or surety for the good behaviour of freemen, — each freeman who was a member of an ancient decennary, tithing, or friborg, in England, being a pledge for the good conduct of the others, for the preservation of the public peace; a free surety.

hanaper - exchequer ‘Hanaper office,’ an office where all writs relating to the public were formerly kept in a hamper (in hanaperio). Hanaper is a cover for a hanap.

livery - the voluntary transfer of something (title or possession) from one party to another.

messuage - house with its land and outbuildings

oyer and terminer - a hearing or an inspection, as of a deed, bond, etc., as when a defendant in court prays oyer of a writing.

purparty - a share, part, or portion of an estate allotted to a coparcener

quitclaim - the transfer of a title, right, or claim to another; to renounce all claim to (a possession or right). Middle English quitclaim, from Anglo-Norman quitclaim, from quiteclamer, to release : quite, free; quite + claimer, to proclaim

seisin is of two kinds, in law and in deed. Seisin in law is where lands descend and the heir has not actually entered upon them; by entry he converts his seisin in law into seisin in deed. Seisin is now confined to possession of the freehold,  though at one time it appears to have been used for simple possession without regard to the estate of the possessor. Its importance is considerably less than it was at one time, owing to the old form of conveyance by feoffment with livery of seisin having been superseded by a deed of grant, and the old rule of descent from the person last seised having been abolished in favour of descent from the purchaser.  Primer seisin was a feudal burden at one time incident to the king’s tenants in capite, whether by knight service or in socage. It was the right of the Crown to receive of the heir, after the death of a tenant in Capite, one year’s profits of lands in possession and half a years profits of lands in reversion. The right was abandoned by the act abolishing feudal tenures (12 Car. II. c. 24, 1660).

socage - feudal tenure of land by a tenant, in return for agricultural or other non-military services or for payment of rent in money. The holder was not a villein, but a free man. His obligations included the duty of attendance at the manor court held by the lord of the manor

supersedeas - the name of a writ containing a command to stay the proceedings at law. It is granted on good cause shown that the party ought not to proceed

tenement - under Feudal law, that which is held of another by service; property which one holds of a lord or proprietor in consideration of some military or pecuniary service; fief; fee. Under Common Law, any species of permanent property that may be held, so as to create a tenancy, as lands, houses, rents, commons, an office, an advowson, a franchise, a right of common, a peerage, and the like;– called also free or frank tenements.  The thing held is a tenement, the possessor of it a “tenant,” and the manner of possession is called “tenure.” –Blackstone.

virgate - a measure of land, varying greatly in extent, but very frequently averaging 30 acres. Equal to a quarter of a hide. Sometimes known as LAND-YARD (Long Yards?), a fixed number of acre, strips of meadow held by bondmen. Usually 30 acres, but sometimes 15 or even 80 acres.

this is a payment, made at court leets in nearly every manor, the origin of which is obscure. It may be  -

1. a payment to the lord originating as a payment in recognition of the superior convenience of attending a court within the manor rather than going outside the manor to the sheriffs town ( if the lord had leet jurisdiction then his tenants were absolved from the necessity of attending the town)

or

2. a payment to compound for the absence of some tithing men who were considered by the lord (after payment of the common fine) to be represented by the chief pledge. N. 1 is more commonly accepted and probably something nearer the truth

(this was the regular procedure designed to ensure that property brought to a man by his wife, which was in law the husband’s property to do with as he pleased, was not, in fact, sold by him against the wishes of his wife. This custom was obviously of limited efficacy.)

Present that James Wryght died (”diem sum clausit extremum- this is the common phrase and gives its name to the writ to the escheator which caused all Inquisition post mortem to be held, to see what reliefs were due to the King upon the death of a tenant-in-chief of the Crown) holding 1 tenement and 15 acres of “ware” land (ie arable land) called Bertottes.

At the court held Wednesday 18th July 2 Elizabeth (1560) it was presented that John Towse died seised of 2 crofts of land in Pledgdon Cannons called ‘Redyngs’  containing 11 acres lately in the tenure of Thomas Story and 2 acres of land lying in the Owtefield (now Outfield Common ?) one head abutting upon the lord’s field of Pledgdon called ‘le Redynge’ on the south, and the other head upon ‘le Dane’, and that William Towse was brother and next heir of John and was 9 years of age.
Custody, during minority, given to Agnes, widow of John Towse senior.
Now William comes of age and is admitted (if William had attained 21 yrs, this indicates that he was born in 1551 and that this Court therefore sat in 1572)

died since last court and before he died, surrendered by Robert Wryght and James Woodley, customary tenants, into the hands of the lord to the use of the last will and testament of Richard, all his lands and tenements held of the manor, viz. one tenement with a full virgate of land called Pynchethorpes, a piece of land called Lewells containing 12 acres. This will dated 5th November 1571 is produced in court and reads

“Also I gyve unto John Stanes my sonne all my copylands and tenements which I do houlde of the lord of this manor by copy of court roule unto the said John Stanes and to his heyrs forever upon this condition following that the said John Stanes, Edward Stanes, Laurence Stanes and William Stanes the summe of fourtye pounds of good and lawful money of England that is I saie to begynne the seventh year next after my decease unto Thomas Stanes my sonne and to paye unto my other children before named yerely the summe of tenne pounds untylle the said sum of fourtye pounds be fully satisfied contented and paide provided always yf any of my said fowr children happen to depart the world before they have receyved there my legacies and bequests that then I will that they shall give the said legacie to who they shall see good….” John Smyth admitted to tenements.

Radulfus Baignardus (Ralph Baynard) has unlawfully seized in Henham half a hide and 10 acres, which were held by two freemen in the time of King Edward. Always one team. It is worth 12 shillings.

Plechedon or Prison Hall in Henham. Founded of Clavelinga. Plicedana is held by Richard of Eudo. It was held by two free men in the time of King Edward for a manor and for five hides less 20 acres. Then four teams in the demesne: afterwards and now 2. Then and afterwards one team of the homagers, now 3 (?). Then and  afterwards 2 villeins, now 6. Then and afterwards 2 bordars, now 16. Then and afterwards 2 serfs, now none. Wood for 20 swine. Twenty acres of meadow. Then 2 horses, now none. Then 2 beasts, now 66 swine. Then 300 sheep, now 200. Six hives of bees. Then and afterwards it was worth 100 shillings, now 8 pounds. Of this property Geoffrey de Mandeville claims 11 hides less 20 acres, and the Hundred testifies in his favour.

Writ of supersedeas in respect of their demand against Thomas, Duke of Gloucester to answer for a yearly farm of £ 180. 11.4d. for the  manor of Burnham, Wodeham Wauter, Little Dunemowe, Henham and Reyndoun co Essex, late of Walter Fitz Wauter of Wodeham, knight, and though on 15 July 11 Richard 11 the king committed to him the wardship of the same at that rent, being in the king’s hand by the said Walter’s death and by reason of the nonage of the heir, and order to discharge the said duke and other the farmers and tenants thereof: as John, bishop of Hereford the treasurer, recollecting a bargain made between him and the duke, has borne a witness before the king that the duke should have to farm for £ 158. 13.8d (sic) a year the manors aforesaid with a hamlet called Ultynge and a moiety of the lordship of Maldoun, which by inadvertence are omitted in the king’s letters patent, and the duke having given up those letters patent in chancery to be cancelled, by other letters patent of the foresaid date the king committed to him the wardship of the said manors, hamlet and moiety from midsummer aforesaid at the rent above mentioned, maintaining the houses and buildings to the name pertaining and bearing all charges, £40 a year being allowed of his farm for maintenance of the heir. Proviso that answer be made by the duke for the farm of £ 158.13.4d (sic) a year.

Order to take the fealties of Henry Stampe and Richard Skylfull and to give them livery of a messuage and half a virgate of land in Henham in the tenure of William Couper, sometime of Richard Chirchegate, a tenement and half a virgate of land there called Turnoures in the tenure of John Turnour, and a tenement and half a virgate of land  there called Appultounes in the tenure of Richard Montagu, parcels of the manor of Henham: as is found by inquisition, taken before the escheator, that Richard Baynarde and Robert Molyton were seised of that manor, which is held in chief, and for good service of Richard Fox to Walter late Lord Fitz Wautier made a grant and - livery of the said parcels to the said Henry and Richard Skylfull and to their assigns during the life of Richard Fox, that they entered the same without license of the king, and that by reason of their trespass the same are taken into the king’s hand: and for a fine paid to the hanaper the king has pardoned their trespass, further granting so far as in him lies that the said grantees shall have the premises again and hold the same to them and their heirs.

Lincoln. Inq. (indented) taken at Flete, Thursday after St. Peters Chains, 37 Edward 111. The deceased is called Joan Fitz Wauter, lady of Egremont in this and the following inquisition.  Flete. A third part of the manor, held for life by gift of Thomas Coulynge, parson of the church of Dysse, with remainder to Walter Fitz Walter, knight and Thomas and Robert his brothers, in common, and the heirs of their bodies, and with further remainder, failing such heirs, to the right heirs of Joan. It is held of the duke of Lancaster, as of the house of Lancaster, by service of a third part of two parts of a knight’s fee, and by rendering yearly to the duke 2/ 2 1/2 and a third part of 1/2d. for ward of Lancaster. Walter and Thomas are alive, and Robert their brother is dead and has an heir whose age the jurors know not because he dwells in the county of Essex. She died on Friday before St. Botolph, 37 Edward 111.’

(1858AD Essex Transactions. Old Series.1.84). Robert de Vere, 9. Earl of Oxford, was by Richard 11, created Marquis of Dublin - died 1388 - this great child of honour bore in his shield three crowns, by special grant from his infatuated sovereign. “This bearing of 3 crowns, quartered with De Vere, may also be seen in the Gentleman’s magazine for October 1818, as on a tile found at Henham, in this county, where the De Veres had possessions”.

To all Christian people unto whome this presente wrightinge shall come James Allen of Steeple Bumpstead in the County of Essex yeoman endeth greetinge in our Lord god Everlastinge Whereas the said James Allen by his deed Indented bearinge date the seaven and twentyth day of November in the Thirteenth yeare of the Raigne of our Soveraigne Lord Kinge Charles of England &c that nowe is Annoque domini 1637 And livery and seyson thereupon given for the consideration of the some of Fifty Pownds of Lawefull English money to him paid Hath graunted bargayned sould enfeoffed and confirmed or mentioned to graunt bargayne sell enfeoffe and confirme unto and to the use of Thomas Unwyn of Bumpstead at the Towre otherwise called Steeple Bumpstead aforesaid gentleman and his heires All that Messuage or Tenement wherein one Willyam Franklyn then dwelt Together with two peeces of pasture adjoyninge to the said house And one Close of arable lande called Longefeiid and one peece of meadowe called little Baldingforfth And all that part of the upper Ley which is Freehold abuttinge upon Henham Woode conteyninge in the whole together be estimation twelve acres more or lesse Lyinge and beinge in Bumpstead aforesaid then in tenure and occupation of the said James Allen his assignes or assignees upon Condition that if James Allen should pay Thomas Unwyn £54 on the last day of November 1638 at the house of Th. Unwyn in Bumpstead aforesaid that then the said grant and livery to be void and Whereas the £54 is unpaid and therefore the said Conveyance has become absolute and Whereas James Allen has since borrowed of Thomas Unwyn the sum of £33.19.6. Now Know that J. Allen has for ever released and quit claimed to T. Unwin his title to the above mentioned estate, except the Messuage or Tenement with the two pieces of pasture adjoining. In witness whereof both parties have set their hands and seals. December 26th 1638. 14th Charles I.

Endorsed. That the above is a true copy of James Allen release to Mr. T. Unwyn which release is remaining in the hands of Sir Thomas Bendishe Baronet by which Release this copy was examined by us Tho-Unwvn & t. Donnett senr.

D/DBi  The Gilbey family record in this collection begins with Henry Gilbey of Bishops Stortford, Hertfordshire (1789-1842). He had several children including three sons Henry Parry Gilbey (1824- 1892), Walter Gilbey (1831-1914) of Elsenham Hall, created first baronet in 1893 and Alfred Gilbey (1833-1879) of Wooburn House, Buckinghamshire, who married Agnes Crosbie in 1858. Sir Walter Gilbey of Elsenham Hall in turn had several children including three sons-Sir Henry Walter Gilbey of Elsenham Hall (1859-1945), Arthur Nockolds Gilbey (1861-1939) and Guy Gilbey (1868-1930). Sir Henry Walter Gilbey had a son Walter Ewart Gilbey (1886-1941) and his eldest son was Sir Walter Derek Gilbey born in 1913 of Elsenham Hall, later of Wineham, Sussex.

The Gilbey family of Elsenham Hall owned land in Elsenham (see D/DBi T1-27, E1), HENHAM (see D/DBi T28-45), Takeley (see D/DBi T48-53) and elsewhere in Essex and also had estates in Hertfordshire acquired by Henry Gilbey of Bishops Stortford (1789-1842), in Wooburn, Buckinghamshire acquired by his son, Alfred (1833-1879) and in Exeter, Lincolnshire, Oxfordshire and London. The brothers Walter (later Sir Walter, 1st Bart.) and Alfred Gilbey established themselves as wine merchants in Oxford Street, London in 1857 and were joined by their brother Henry Gilbey in 1864 (see D/DBi B2). The business was expanded in 1860s to include agencies in Upper Sackville Street, Dublin, the Haymarket, Edinburgh and in Carmarthen, Newport and Swansea as well as London (see D/DBi B6-8, B15). Property in the wine producing region of Medoc, France was purchased before 1900 (see D/DBi T81). Interest in the tobacco trade was acquired with shares in R. and J. Hill Ltd. (see D/Dbi B22, B34). In the 1880s and 1890s, other members of the Gilbey family were brought into the wine and spirit business (see D/DBi B25-33).

The Manor appears to have been granted by Richard de Reimes, to Roger de Mesing, with his daughter Amicia in marriage, but Roger was heir of Anketil de Messing, who had also held lands in Messing. Roger de Messing had a daughter, wife of Thomas Bainard, whence the Manor came to the Baynard family. Richard Baynard, dying 1473, left a daughter and heiress Grace, wife (2) of Edmund Danyell. The Manor passed to the Danyell family, the last of whom, John Daniell, sold it with the other Manors in 1582 to Thomas Diggs, who sold them to Christopher Chiborne. Eventually in 1650 Richard Chiborne sold them to Capell Luckyn. Domesday Book, 1086. ‘Land of Radualfus aignardus’. ‘Metcinges is held of Bernardus of Radulfus. It was held in King Edward’s time by a free woman for a Manor and \’bd a hide. Now there is 1 border there, and wood for 12 swine. The value was 10s., now 3s.’ Ralph Baignard held also Manors is Essex at Ulting, Cold Norton, Woodham Walter, Curlai, Little Dunmow, Wimbish, Boroolditima, Pentlow, Burnham, Little Baddow, East Haningfield, Adem, Ramsey, Michelstow, Lawford, Wenden Loughts, HENHAM Hall, Ashden, Langford, and Barnewalden in Tolleshunt Knights, i.e. with Messing, 21 Manors, and also lands at Langford in Thurstable and Mageldana. Land of Roger de Raimis ‘Metcinges held by Roger in demesne. It was held in King Edward’s time by Ormar, a freeman, for a Manor and \’bd hide. There were then 6 villeins, now 3, 12 bordars, now 18, and 6 serfs, now 4. Then and now 2 teams in the demesne. Among the homagers were 5 teams, now 3. Wood for 40 swine, 20 acres of meadow, and now 1 mill. Then and now 2 horses, 2 cows with calves, and 100 sheep. Then 30 swine, now 20. Then and now 35 goats. The land has always been worth 100s. Of this manor Auschetillus holds of Roger 16 acres, and this is worth 5s. of the above value. Three sokeman holding (? who formerly held) in free tenure 18 acres belong to this Manor, and these Geroldus holds of Roger, and Roger says that he holds them in exchange.

D/DPn  Descent of the Manor of Sheering Hall, 1689-1725, from the evidence of D/Dpn T1/1-45, T2/1-16, supplementing and correcting the account in Morant, History of Essex , vol.II, p.500. Lord Viscount Hewitt (d. 1689) left all his estates, which included the Manor of Sheering Hall, to his four sisters. They instituted proceedings in Chancery in order that a fair division might be made and the commission established by that court allotted the Manor of Sheering to Dame Elizabeth Anderson (1691-2). She died in 1698 leaving it in trustees' hands to be sold and they agreed to sell it to Thomas Filmer for £5,200 [D/DPn T1/29]; he died, however, before the formal conveyance could be completed and the transaction was not finally settled until 1706. His daughters, Mary Filmer and Susanna Eddowes, in 1718 sold it for £6,300 to Robert Chester, a director of the South Sea Co.; he later acquired other property in Sheering which had also formed part of the original Hewitt estate as divided in 1692; both were forfeited upon the failure of the South Sea Co. and sold by the trustees to Samuel Feake for £11,325. \b D/Dpn T3-23. These bundles of deeds all relate to properties in Sheering acquired by the Glyn family, principally Rev. Thomas Clayton Glyn, in the early part of the nineteenth century. \b D/Dpn F1,2. Upon the death of their brother Samuel in 1774, Anne and Mary Feake inherited as co-heiresses the Manors of HENHAM and Sheering, etc.; Mary Feake died unmarried in 1803 leaving her moiety to Thomas Glyn and his wife Henrietta, wife Henrietta, which moiety was in turn inherited by their eldest son the Rev. Tho. Clayton Glyn. In 1844 it was agreed to make a partition of the whole estate, as there were too many co-heirs, and in that partition the Manor of Sheering, Durrington House and the Sheering Estates fell to the Rev.
